Armorer from ‘Rust’ claims evidence was concealed by state, seeks prison release

From the ⁣heart of SANTA FE, N.M. — The legal representatives of Hannah Gutierrez, who was the primary armorer on the set of the Western film “Rust,” have made a bold claim. In a court filing on Thursday, they stated that​ the ‍prosecution‍ had deliberately kept back evidence that could have potentially swung the​ verdict in ‍Gutierrez’s favor during her manslaughter ‍trial.

This development has emerged just as a⁢ New Mexico judge is preparing to make a decision on ⁣Friday. The decision pertains to a request from Alec Baldwin’s legal​ counsel to dismiss the manslaughter charge against him. This ⁣charge is related to the tragic incident that occurred on the set of “Rust.”

During the production of the movie in 2021,​ a horrific accident took place. Cinematographer Halyna Hutchins⁣ was fatally⁤ shot⁢ by a prop gun‌ that was being operated by Baldwin at that moment.

The​ court filing reveals that ‍the state prosecutors had in their possession‍ a report from their weapons experts. ⁣This report​ indicated that the prop ⁣gun used on the “Rust” set had “unexplained‌ tool marks​ on critical surfaces of the trigger and sear.”

Jason ⁢Bowles,​ Gutierrez’s lawyer, ‌stated that​ this is ⁣crucial evidence. ⁤It supports the argument that ⁢the ⁣gun could have discharged accidentally, a point that both Baldwin and​ Gutierrez’s legal teams have been making. This evidence could‍ have potentially resulted​ in Gutierrez being acquitted.

Bowles has made a plea for Gutierrez to be released from prison ⁣while awaiting a new trial.

He‌ claimed that⁢ he ‌came across this information during the evidentiary hearings in Baldwin’s⁢ case this‌ week. He described it as “bombshell exculpatory evidence” that the prosecutors had intentionally kept ​hidden. ‌According ‍to him, ‌this evidence “would have resulted in a fundamentally different trial and ​likely a different⁣ outcome” for Gutierrez.

The state⁣ prosecutors have not yet responded to these allegations. During the evidentiary hearings in⁢ Baldwin’s case, one of the state’s ‌weapons experts admitted that he had initially reported that the marks on the gun might not have been caused during FBI testing. However, he later⁤ concluded that they indeed had‍ been.

In March, Gutierrez, aged ⁣27, was convicted of involuntary manslaughter ⁣for‌ accidentally loading a live round into​ a revolver ​that Baldwin was using on ​a movie set in Santa Fe, New Mexico.‍ She received ⁤her sentence in ‌April, which was 18 months in prison.

The ⁢incident, which sent shockwaves through Hollywood, is ​thought to be the first instance in recent history where a​ film crew or cast member was killed ⁤by a live round accidentally loaded into a gun.

Baldwin’s trial is scheduled for July 10.⁢ He was indicted by a grand jury on a charge of involuntary manslaughter in January.
