From the heart of SANTA FE, N.M. — The legal representatives of Hannah Gutierrez, who was the primary armorer on the set of the Western film “Rust,” have made a bold claim. In a court filing on Thursday, they stated that the prosecution had deliberately kept back evidence that could have potentially swung the verdict in Gutierrez’s favor during her manslaughter trial.
This development has emerged just as a New Mexico judge is preparing to make a decision on Friday. The decision pertains to a request from Alec Baldwin’s legal counsel to dismiss the manslaughter charge against him. This charge is related to the tragic incident that occurred on the set of “Rust.”
During the production of the movie in 2021, a horrific accident took place. Cinematographer Halyna Hutchins was fatally shot by a prop gun that was being operated by Baldwin at that moment.
The court filing reveals that the state prosecutors had in their possession a report from their weapons experts. This report indicated that the prop gun used on the “Rust” set had “unexplained tool marks on critical surfaces of the trigger and sear.”
Jason Bowles, Gutierrez’s lawyer, stated that this is crucial evidence. It supports the argument that the gun could have discharged accidentally, a point that both Baldwin and Gutierrez’s legal teams have been making. This evidence could have potentially resulted in Gutierrez being acquitted.
Bowles has made a plea for Gutierrez to be released from prison while awaiting a new trial.
He claimed that he came across this information during the evidentiary hearings in Baldwin’s case this week. He described it as “bombshell exculpatory evidence” that the prosecutors had intentionally kept hidden. According to him, this evidence “would have resulted in a fundamentally different trial and likely a different outcome” for Gutierrez.
The state prosecutors have not yet responded to these allegations. During the evidentiary hearings in Baldwin’s case, one of the state’s weapons experts admitted that he had initially reported that the marks on the gun might not have been caused during FBI testing. However, he later concluded that they indeed had been.
In March, Gutierrez, aged 27, was convicted of involuntary manslaughter for accidentally loading a live round into a revolver that Baldwin was using on a movie set in Santa Fe, New Mexico. She received her sentence in April, which was 18 months in prison.
The incident, which sent shockwaves through Hollywood, is thought to be the first instance in recent history where a film crew or cast member was killed by a live round accidentally loaded into a gun.
Baldwin’s trial is scheduled for July 10. He was indicted by a grand jury on a charge of involuntary manslaughter in January.
