Defense Claims No Immediate Plea Deal as Persia Nelson’s Hearing is Postponed

SCHENECTADY — The scheduled court hearing ‍for Persia Nelson, ⁢a Schenectady ⁤resident and mother who stands accused of ⁤the ‍murder of her 11-month-old daughter, Halo Branton, in March, was postponed on Monday to a yet-to-be-determined future date.

Nelson, ‍aged 25, was conspicuously absent ⁢from Monday’s county court​ session. ‌She is charged with abandoning Halo in a utility tunnel on the General ‌Electric campus in Schenectady on March 9, leading​ to the infant’s death from exposure and hypothermia.

On‍ the night of ⁢March 9, at 11:04 p.m., county ​dispatchers received a call from‍ GE security. They reported a female trespasser, later identified as Nelson, on​ the company’s premises, claiming she had misplaced her child. Nelson‌ was subsequently discovered inside a building on the campus.

The following day, just after ⁢noon, Halo was discovered inside a ‍utility‍ tunnel on the GE campus, where she had been left in a pool of water eight feet deep,​ following an exhaustive police search.

In⁤ April, Nelson entered a plea of not guilty ‌to‌ felony⁣ charges of second-degree murder, depraved indifference to human life, and second-degree manslaughter, as well as a misdemeanor charge of endangering the welfare of a child.

After a private meeting between Schenectady County Judge Matthew Sypniewski and attorneys from both the prosecution‌ and defense, Monday’s scheduled hearing was postponed, with no subsequent court dates currently set.

“We’re in a ⁣holding pattern,⁤ waiting to either reschedule the hearing or leave it on the trial calendar,”‍ Assistant‌ District Attorney ⁤Christina Tremante commented after the hearing.

Stephen Signore, Nelson’s attorney and public defender, stated that​ the ⁤defense is contemplating whether to proceed ⁢with‍ a Huntley Hearing, ⁣which‍ is designed to determine the admissibility of statements made by ​the defendant to law enforcement.

“We’re examining certain elements that ​would have formed⁤ the basis of the hearing, specifically statements made during the investigation, to establish⁣ what, if anything, we believe could jeopardize the defense,” Signore stated on Monday. “We’re essentially deciding if‍ we need​ to proceed‌ with any hearings ⁢concerning these statements.”

Signore also mentioned on Monday‍ that the defense is not contemplating a plea deal at this stage.

“While the prospect of a⁤ plea deal exists, I don’t foresee it happening⁣ at this early ‌stage of ⁢the proceedings,” he added.
