ALBANY, N.Y. (AP) — In a landmark decision, the highest court in New York has upheld a law that allows any registered voter to cast their vote by mail. This ruling comes as a response to a Republican challenge to the legislation.
The state Court of Appeals, in a 6-1 ruling, confirmed the decisions of lower courts, stating that the voting expansion law, which was passed by the Legislature last year, does not infringe on the state’s constitution. The lawsuit was a part of a broader GOP initiative to tighten voting regulations following the 2020 election, spearheaded by U.S. Rep. Elise Stefanik.
The challengers of the law contended that the Constitution necessitates most people to vote in person.
However, Chief Judge Rowan Wilson, authoring the majority opinion, stated that there is no “clear, unequivocal, and persistent” interpretation by the government that the constitution mandates in-person voting.
In 2021, Democrats made an attempt to broaden mail voting through a constitutional amendment. However, this proposal was turned down by voters after a campaign led by conservatives who argued it would pave the way for voter fraud.
Ed Cox, the State Republican Party Chairman, highlighted the voters’ rejection of the amendment in a prepared statement. He described the top court’s decision as “an affront” to the people of New York.
“This ruling is clearly in opposition to what generations of New York legislators, attorneys, and judges have decided, and what the people expressed in 2021 when they rejected the amendment,” Cox stated.
