US Judge Rules X Must Confront Class Action Allegations of Age Discrimination Following Mass Dismissal

SAN FRANCISCO — A landmark ruling has been made by a federal judge in San Francisco, allowing approximately 150 senior employees, who were dismissed by ⁣social media ⁣giant⁤ X following its acquisition by Elon Musk, to collectively sue for age discrimination. This could potentially cost the company millions in damages.

The ruling‍ was made by U.S. District Judge Susan Illston, who released her decision late Tuesday. She highlighted that the case raises a ⁢significant question⁢ about the effect of a 2022 mass redundancy at the company⁣ on employees ⁣aged 50 and above.

The ‍lawsuit was⁢ initiated by John Zeman, a ‍former employee of X’s communications department when the company was still known as Twitter. Zeman filed the lawsuit in 2023, alleging that X dismissed 60% of its employees aged ​50 or ⁢above and ‍almost 75%⁢ of ‍those aged over 60, in contrast to 54% ​of employees under ⁤the age of 50.

Illston wrote in her ruling, “Plaintiff has demonstrated more than just conjecture that⁢ Twitter may have​ discriminated against older employees in the Nov. 4, 2022 (mass redundancy), which⁤ constitutes⁤ a single decision that impacted all members of the proposed class.”

Following Tuesday’s ruling, Zeman’s legal team can now send notice of the⁤ lawsuit to potential ⁣class members, offering them the opportunity to join the case.

X has yet to comment ⁤on⁢ the ruling.⁣ The company‍ has previously denied any allegations of discrimination, stating that it dissolved the entire communications department‌ where Zeman ‌was employed after Musk’s takeover,⁣ irrespective of the employees’ ages.

Shannon Liss-Riordan, an attorney representing Zeman and approximately 2,000 other former Twitter employees who have filed a ‍series‌ of legal claims ⁤against the⁣ company, ​expressed satisfaction with the ruling.

This lawsuit is one among roughly a dozen that X has been faced with, following Musk’s decision to lay off more​ than half of Twitter’s workforce in ⁢2022.

These ⁢cases⁤ encompass ⁤a variety of allegations, all of which X has denied.‌ These​ include claims that the ⁣company dismissed employees and contractors without providing the necessary advance notice, ⁢disproportionately targeted women for⁤ layoffs,‌ and discriminated against ⁣workers with disabilities by prohibiting remote work.

In August, two judges ⁢independently dismissed the‌ gender⁢ and⁣ disability bias cases, while permitting the plaintiffs to submit ⁤revised complaints​ to further detail their claims.

Two additional⁤ lawsuits allege that the company‌ owes its former employees a ⁤minimum of $500 million ​in severance pay. One ⁢of ‍these cases was dismissed in July.
